Agreement to Terms

By downloading, installing, or using SipStreak ("the app"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the app.

SipStreak is developed and operated by Victor Solano ("we," "us," "our").

Eligibility

You must be at least 13 years old to use SipStreak. By using the app, you represent that you meet this age requirement. If you are under 18, you represent that your parent or legal guardian has reviewed and agrees to these Terms on your behalf.

Description of Service

SipStreak is an iOS application that helps you track daily water intake, maintain hydration streaks, and build a consistent drinking habit. The app includes:

• One-tap water logging with customizable glass sizes and presets
• Daily streak tracking with milestone celebrations at 3, 7, 14, 30, 60, 90, 180, and 365 days
• HealthKit integration (opt-in) to read body mass and write dietary water entries to Apple Health
• WidgetKit home screen widget showing today's intake, daily goal, and streak count
• Local notifications for customizable hydration reminders with quiet hours
• Cosmetic themes (3 free, 7 additional with one-time Pro purchase)

All data is stored locally on your device. There are no user accounts, no cloud sync, and no backend servers.

HealthKit Data

SipStreak optionally integrates with Apple HealthKit. When you enable this feature in Settings:

• The app reads your body mass to suggest a personalized daily water goal.
• The app writes dietary water intake entries to Apple Health.

HealthKit access is entirely opt-in. If you decline or never enable it, the app functions fully without it. No health data is uploaded, transmitted, or shared with any server or third party. All HealthKit interactions occur entirely on your device through Apple's HealthKit framework.

You can revoke HealthKit permissions at any time in iOS Settings > Privacy & Security > Health > SipStreak.

In-App Purchases

SipStreak offers a one-time, non-consumable "Pro" upgrade through Apple's App Store. This purchase unlocks 7 additional cosmetic themes and is processed by Apple, subject to Apple's App Store Terms and Conditions.

• Pricing is displayed before purchase and may vary by region.
• Refunds are handled by Apple. To request a refund, visit reportaproblem.apple.com.
• Restore previous purchases via Settings > Pro > Restore Purchase.

Data Loss Disclaimer

SipStreak stores all water intake data, streak records, and user preferences locally on your device. There is no cloud backup and no account system.

Your data will be lost if:

• You uninstall the app
• You perform a factory reset on your device
• Your device is lost, stolen, or destroyed

We cannot recover your data under any circumstances. We recommend exporting important data via HealthKit before uninstalling.

Acceptable Use

You agree not to:

• Reverse engineer, decompile, or disassemble the app.
• Use the app for any unlawful purpose.
• Attempt to interfere with the app's normal operation.
• Exploit bugs, vulnerabilities, or unintended behavior for unfair advantage.

Intellectual Property

SipStreak, including its design, code, graphics, animations, and branding, is the intellectual property of Victor Solano. All rights reserved.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the app for personal, non-commercial purposes subject to these Terms.

Disclaimer of Warranties

SipStreak is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

• The app will be uninterrupted, error-free, or free of harmful components.
• Water intake tracking or goal calculations will be medically accurate.
• HealthKit data will sync without errors in all conditions.

SipStreak is not a medical device and is not intended to diagnose, treat, cure, or prevent any medical condition. Consult a healthcare professional for personalized hydration advice.

Limitation of Liability

To the maximum extent permitted by applicable law, Victor Solano shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of or inability to use the app.

This includes, without limitation:

• Loss of water intake data or streak records due to device loss, app uninstall, or any other cause.
• Health decisions made based on the app's tracking or goal suggestions.

Our total liability for any claim arising from these Terms or your use of the app shall not exceed the amount you paid for the app (including in-app purchases) in the 12 months preceding the claim.

Apple End User License Agreement Terms

This agreement is between you and Victor Solano, not Apple. Apple is not responsible for SipStreak or its content.

1. Acknowledgement

These Terms constitute an agreement between you and Victor Solano only, and not with Apple. Victor Solano, not Apple, is solely responsible for SipStreak and its content.

2. Scope of License

The license granted to you for SipStreak is limited to a non-transferable license to use SipStreak on any Apple-branded device that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms of Service.

3. Maintenance and Support

Victor Solano is solely responsible for providing any maintenance and support services for SipStreak, as specified in these Terms or as required under applicable law. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to SipStreak.

4. Warranty

Victor Solano is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of SipStreak to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for SipStreak to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to SipStreak, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be Victor Solano's sole responsibility.

5. Product Claims

Victor Solano, not Apple, is responsible for addressing any claims you or any third party may have relating to SipStreak or your possession and/or use of SipStreak, including but not limited to: (i) product liability claims; (ii) any claim that SipStreak fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

6. Intellectual Property Claims

Victor Solano, not Apple, is responsible for the investigation, defense, settlement, and discharge of any third-party intellectual property infringement claim relating to SipStreak or your possession and use of SipStreak.

7. Legal Compliance

You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

8. Third-Party Beneficiary

Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

9. Third-Party Terms of Agreement

You must comply with applicable third-party terms of agreement when using SipStreak. For example, if you use a VoIP application, you must not be in violation of their wireless data service agreement when using SipStreak.

Termination

We reserve the right to terminate or suspend your access to the app at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or us.

Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top. Continued use of the app after changes constitutes acceptance of the revised Terms.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Florida, United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in the State of Florida.

If you are a consumer in the European Union, nothing in this section affects your rights under mandatory consumer protection laws of your country of residence.

General Provisions

Severability. If any provision of these Terms is held to be unenforceable, the remaining provisions shall remain in full force and effect.

Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding SipStreak and supersede any prior agreements.

Assignment. You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights without restriction.

Waiver. Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.

Notices. We may provide notices to you through the app or by updating these Terms. You are responsible for reviewing the Terms periodically.

Force Majeure. We shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to natural disasters, internet or infrastructure failures, or third-party service outages.
