Terms of Service for Ignis.

This page documents the terms and conditions for using Ignis. Please read them carefully before using the app.

Agreement to Terms

By downloading, installing, or using Ignis ("the app"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the app.

Ignis is developed and operated by TheChosenVictor LLC ("we," "us," "our"). Victor Solano owns TheChosenVictor LLC.

Eligibility

You must be at least 13 years old (or the age of digital consent in your country) to use Ignis. By using the app you confirm that you meet this requirement.

Not Medical Advice

PLEASE READ CAREFULLY.

Ignis is a personal tracking tool, not a medical device, and it does not provide medical, nutritional, or health advice. The fasting stages it displays (such as fat-burning, ketosis, and autophagy) are general wellness information based on elapsed time, not a measurement of your body and not a diagnosis or treatment.

Intermittent fasting is not appropriate for everyone. Consult a qualified healthcare professional before starting any fasting program, especially if you are pregnant or nursing, are under 18, have diabetes or another medical condition, take medication, or have a history of disordered eating. Stop fasting and seek medical attention if you feel unwell. You use Ignis at your own risk.

Description of Service

Ignis is an iOS application for tracking intermittent fasting. The app includes:

A fasting timer with a live stage ring that progresses as your fast continues
Fasting protocols including 16:8, 18:6, 20:4, OMAD, and a custom window
A Lock Screen Live Activity and Dynamic Island for the active fast
Streaks and history to review your progress over time
Home-screen widgets
Local-only storage. All fasting data exists only on your device

Data Loss Disclaimer

PLEASE READ CAREFULLY.

Ignis stores all fasting data locally on your device using SwiftData. There is no cloud backup, no sync service, and no way for the developer to access or recover your data.

Your fasting data will be permanently lost if:

Your device is lost, stolen, or destroyed
You uninstall the app
The device undergoes a factory reset
The device's hardware fails

We cannot recover your data under any circumstances. There is no cloud backup and no server-side storage. You are solely responsible for understanding this limitation.

In-App Purchases

Ignis offers a "Pro" upgrade through Apple's App Store. This purchase is processed by Apple and subject to Apple's App Store Terms and Conditions.

Ignis Pro is a one-time purchase, not a subscription.
Pricing is displayed before purchase and may vary by region.
Refunds are handled by Apple. To request a refund, visit reportaproblem.apple.com.
Restore previous purchases via Settings > Restore Purchases.

Advertising

The free version of Ignis may show Google AdMob ads outside the fasting timer. Ads are never shown on the active timer ring. Ignis Pro removes ads.

Google AdMob and Google's consent tools may process advertising-related data as described in the Privacy Policy. Your fasting sessions, schedules, and history are not sent to Google for ad targeting.

Acceptable Use

You agree not to:

Reverse engineer, decompile, or disassemble the app.
Use the app for any unlawful purpose.
Attempt to interfere with the app's normal operation.
Attempt to extract data from the app's sandboxed storage through unauthorized means.

Intellectual Property

You are granted a limited, non-exclusive, non-transferable, revocable license to use the app for personal, non-commercial purposes subject to these Terms.

Disclaimer of Warranties

Ignis is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

The app will be uninterrupted, error-free, or free of harmful components.
Your data will be recoverable under any circumstances.
The fasting stages, timers, or reminders are accurate for your individual physiology or suitable for any medical or therapeutic purpose.

Ignis is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of a qualified health provider with any questions you may have regarding fasting or a medical condition.

Limitation of Liability

To the maximum extent permitted by applicable law, TheChosenVictor LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of or inability to use the app.

This includes, without limitation:

Loss of fasting history due to device loss, app uninstallation, or any other cause.
Any health consequences related to fasting undertaken while using the app.
Unauthorized access to your device and its locally stored data.

Our total liability for any claim arising from these Terms or your use of the app shall not exceed the amount you paid for the app (including in-app purchases) in the 12 months preceding the claim.

Apple End User License Agreement Terms

This agreement is between you and TheChosenVictor LLC, not Apple. Apple is not responsible for Ignis or its content.

1. Acknowledgement

These Terms constitute an agreement between you and TheChosenVictor LLC only, and not with Apple. TheChosenVictor LLC, not Apple, is solely responsible for Ignis and its content.

2. Scope of License

The license granted to you for Ignis is limited to a non-transferable license to use Ignis on any Apple-branded device that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms of Service.

3. Maintenance and Support

TheChosenVictor LLC is solely responsible for providing any maintenance and support services for Ignis, as specified in these Terms or as required under applicable law. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to Ignis.

4. Warranty

TheChosenVictor LLC is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of Ignis to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for Ignis to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to Ignis.

5. Product Claims

TheChosenVictor LLC, not Apple, is responsible for addressing any claims you or any third party may have relating to Ignis or your possession and/or use of Ignis, including but not limited to: (i) product liability claims; (ii) any claim that Ignis fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

6. Intellectual Property Claims

TheChosenVictor LLC, not Apple, is responsible for the investigation, defense, settlement, and discharge of any third-party intellectual property infringement claim relating to Ignis or your possession and use of Ignis.

7. Legal Compliance

You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

8. Third-Party Beneficiary

Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

9. Third-Party Terms of Agreement

You must comply with applicable third-party terms of agreement when using Ignis.

Termination

We reserve the right to terminate or suspend your access to the app at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or us.

Upon termination, your license to use the app is immediately revoked. Note that due to the local-only nature of Ignis, uninstalling the app will permanently delete all fasting data stored within it.

Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top. Continued use of the app after changes constitutes acceptance of the revised Terms.

General Provisions

Severability. If any provision of these Terms is held to be unenforceable, the remaining provisions shall remain in full force and effect.

Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding Ignis and supersede any prior agreements.

Assignment. You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights without restriction.

Waiver. Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.

Force Majeure. We shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to natural disasters, internet or infrastructure failures, or third-party service outages.
