These Terms of Use ("Terms") govern your use of NightHours ("the app"). NightHours is developed and operated by TheChosenVictor LLC ("we," "us," or "our"). Victor Solano owns TheChosenVictor LLC.
By downloading, installing, or using the app, you agree to these Terms. If you do not agree, do not use the app.
NightHours is a local-first iPhone utility for logging supervised learner-permit practice hours. Features may include remaining-hour totals, night/day split, optional automatic detection, exports, backups, reminders, App Lock, and an optional Lifetime Household purchase.
NightHours is a personal practice-hour log. It is not an official DMV, BMV, or licensing-agency form. It is not legal advice. Check your state's accepted record format before a road test. Families required to use an official state app (for example RoadReady Ohio) should use that app.
You retain ownership of learner names, drive records, notes, signatures, and other content you add. You are responsible for having the right to use that content and for keeping it lawful.
The app stores that content locally. TheChosenVictor LLC does not operate a NightHours account or data backend and cannot recover data deleted from your device. You are responsible for protecting your device, creating backups when appropriate, keeping backup recovery material safe, and choosing secure destinations for readable exports.
Remaining-hour totals, night/day splits, and sunset estimates are generated from app rules, the bundled state table, timestamps, and optional location. They may be incomplete, out of date, or unsuitable for a particular state or test. Review the result, correct the split before you save, and use your own judgment. You remain responsible for a missed road-test date, a rejected printout, or a state rule change you did not override.
NightHours may offer a one-time Lifetime Household purchase through Apple's App Store. The capabilities included are shown on the purchase screen: unlimited logged drives, every learner in your household on this Apple ID, and exports without the free-tier sample stamp. Already-logged drives stay yours whether or not you purchase.
Apple shows the price for your storefront before purchase and processes the transaction. This is not a subscription.
Use Restore Purchases in the app to restore an eligible previous purchase. Apple handles refunds; requests can be made through reportaproblem.apple.com.
These Terms supplement Apple's Licensed Application End User License Agreement (the "Standard EULA"), which also applies to your use of NightHours. If these Terms conflict with the Standard EULA or rights that applicable law does not allow you to waive, the Standard EULA and those non-waivable rights control.
You may not use NightHours unlawfully; use it to falsify a licensing record; interfere with its normal operation; attempt unauthorized access to another person's device or data; or copy, distribute, resell, or reverse engineer the app except where applicable law expressly permits it.
The attestation on an export is your statement.
NightHours's code, design, branding, bundled rule table, and other app materials belong to TheChosenVictor LLC or its licensors. Your ownership of content you add is not affected by this section.
We may fix, update, change, or discontinue app features. When these Terms materially change, we will update the effective date above.
