Hushlayer Terms of Service

These Terms of Service ("Terms") govern your use of Hushlayer, an iOS ambient sound mixer operated by TheChosenVictor LLC ("we," "us," or "our"). By using Hushlayer, you agree to these Terms.

What Hushlayer Is

Hushlayer lets you play bundled ambient sounds, build layered soundscapes, save mixes, and set fade-out timers. The app is designed for sleep, focus, and relaxation.

No Medical Advice

Hushlayer is not a medical device. It does not provide medical advice, diagnosis, treatment, monitoring, or emergency assistance. Ambient audio may be helpful for relaxation, but it is not a substitute for professional medical care. If you have a medical concern, contact a qualified healthcare professional.

Free Tier and Ads

The free version of Hushlayer may display ads through Google AdMob. Ad behavior, consent, and privacy controls are described in the Hushlayer Privacy Policy.

Hushlayer Pro

Hushlayer Pro is a one-time in-app purchase handled by Apple StoreKit. Pro removes ads and unlocks multi-sound mixing, unlimited saved mixes, and the full timer set.

Prices are shown in the app before purchase and may vary by country, region, tax rules, and Apple App Store settings. Payment, refunds, and purchase restoration are handled by Apple under Apple Media Services terms.

Purchases and Restore

If you buy Hushlayer Pro, your purchase is tied to the Apple ID used for the transaction. Use Restore Purchase in the app to restore Pro on a compatible device.

We cannot issue App Store refunds directly. Refund requests must go through Apple.

Acceptable Use

You agree not to misuse Hushlayer, interfere with the app or its services, reverse engineer the app except where legally permitted, or use the app in a way that violates applicable law.

Intellectual Property

Hushlayer, its interface, branding, bundled audio arrangements, code, and related materials are owned by TheChosenVictor LLC or its licensors. You receive a personal, non-transferable right to use the app according to these Terms.

Third-Party Services

Hushlayer uses Apple platform services for App Store distribution, StoreKit purchases, and system permissions. The free tier uses Google AdMob and Google User Messaging Platform for ads and consent handling.

Your use of those services may also be governed by Apple and Google terms and policies.

Availability and Changes

We may update, modify, or discontinue parts of Hushlayer. We may also fix bugs, change features, adjust free-tier limits, or update Pro benefits while preserving purchased access to the paid features described in the app at the time of purchase where required by law.

Disclaimer

Hushlayer is provided "as is" and "as available." We do not guarantee that the app will be uninterrupted, error-free, or suitable for any specific sleep, focus, health, or wellness outcome.

Limitation of Liability

To the maximum extent permitted by law, TheChosenVictor LLC is not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of Hushlayer.

Governing Law

These Terms are governed by the laws of the United States and the state where TheChosenVictor LLC is organized, without regard to conflict of law principles.
