This page documents the terms and conditions for using Gloam. Please read them carefully before using the app.

Agreement to Terms

By downloading, installing, or using Gloam ("the app"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the app.

Gloam is developed and operated by Victor Solano ("we," "us," "our").

Eligibility

You must be at least 4 years old to use Gloam (or have parental consent). This corresponds to the app's 4+ rating on the Apple App Store.

Description of Service

Gloam is an iOS application that provides a daily micro-journal for personal reflection. The app includes:

  • Daily prompts that encourage thoughtful reflection
  • Mood tracking with intuitive selection chips
  • Streak tracking to build a journaling habit
  • Timeline view to revisit past entries
  • Focus Shroud for distraction-free writing
  • Local-only storage. All journal data exists only on your device

Data Loss Disclaimer

PLEASE READ CAREFULLY.

Gloam stores all journal entries locally on your device using SwiftData. There is no cloud backup, no sync service, and no way for the developer to access or recover your data.

Your journal data will be permanently lost if:

  • Your device is lost, stolen, or destroyed
  • You uninstall the app
  • The device undergoes a factory reset
  • The device's hardware fails

We cannot recover your data under any circumstances. There is no cloud backup and no server-side storage. You are solely responsible for understanding this limitation.

We recommend using the Export feature (Pro) to periodically back up your journal entries as PDF or plain text files.

Camera and Photo Library Access

Gloam requests camera access for the Pro photo attachment feature only. Photos taken through the app are saved within the app's sandboxed container. Gloam never accesses your full photo library.

In-App Purchases

Gloam offers a "Pro" upgrade through Apple's App Store. This purchase is processed by Apple and subject to Apple's App Store Terms and Conditions.

  • Pricing is displayed before purchase and may vary by region.
  • Refunds are handled by Apple. To request a refund, visit reportaproblem.apple.com.
  • Restore previous purchases via Settings > Restore Purchase.

Acceptable Use

You agree not to:

  • Reverse engineer, decompile, or disassemble the app.
  • Use the app for any unlawful purpose.
  • Attempt to interfere with the app's normal operation.
  • Attempt to extract data from the app's sandboxed storage through unauthorized means.

Intellectual Property

Gloam, including its design, code, graphics, prompts, and branding, is the intellectual property of Victor Solano. All rights reserved.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the app for personal, non-commercial purposes subject to these Terms.

Disclaimer of Warranties

Gloam is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

  • The app will be uninterrupted, error-free, or free of harmful components.
  • Your data will be recoverable under any circumstances.
  • The daily prompts will be suitable for therapeutic or medical purposes.

Gloam is not a substitute for professional mental health support. If you are experiencing emotional distress, please contact a qualified professional.

Limitation of Liability

To the maximum extent permitted by applicable law, Victor Solano shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of or inability to use the app.

This includes, without limitation:

  • Loss of journal entries due to device loss, app uninstallation, or any other cause.
  • Emotional distress related to journal content or prompts.
  • Unauthorized access to your device and its locally stored data.

Our total liability for any claim arising from these Terms or your use of the app shall not exceed the amount you paid for the app (including in-app purchases) in the 12 months preceding the claim.

Apple End User License Agreement Terms

This agreement is between you and Victor Solano, not Apple. Apple is not responsible for Gloam or its content.

1. Acknowledgement

These Terms constitute an agreement between you and Victor Solano only, and not with Apple. Victor Solano, not Apple, is solely responsible for Gloam and its content.

2. Scope of License

The license granted to you for Gloam is limited to a non-transferable license to use Gloam on any Apple-branded device that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms of Service.

3. Maintenance and Support

Victor Solano is solely responsible for providing any maintenance and support services for Gloam, as specified in these Terms or as required under applicable law. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to Gloam.

4. Warranty

Victor Solano is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of Gloam to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for Gloam to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to Gloam.

5. Product Claims

Victor Solano, not Apple, is responsible for addressing any claims you or any third party may have relating to Gloam or your possession and/or use of Gloam, including but not limited to: (i) product liability claims; (ii) any claim that Gloam fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

6. Intellectual Property Claims

Victor Solano, not Apple, is responsible for the investigation, defense, settlement, and discharge of any third-party intellectual property infringement claim relating to Gloam or your possession and use of Gloam.

7. Legal Compliance

You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

8. Third-Party Beneficiary

Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

9. Third-Party Terms of Agreement

You must comply with applicable third-party terms of agreement when using Gloam.

Termination

We reserve the right to terminate or suspend your access to the app at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or us.

Upon termination, your license to use the app is immediately revoked. Note that due to the local-only nature of Gloam, uninstalling the app will permanently delete all journal data stored within it.

Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top. Continued use of the app after changes constitutes acceptance of the revised Terms.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Florida, United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in the State of Florida.

If you are a consumer in the European Union, nothing in this section affects your rights under mandatory consumer protection laws of your country of residence.

General Provisions

Severability. If any provision of these Terms is held to be unenforceable, the remaining provisions shall remain in full force and effect.

Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding Gloam and supersede any prior agreements.

Assignment. You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights without restriction.

Waiver. Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.

Force Majeure. We shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to natural disasters, internet or infrastructure failures, or third-party service outages.
